While bankruptcy may be very beneficial it is not the answer for everyone. Some people may not qualify for bankruptcy because they recently filed a previous bankruptcy or their income level make bankruptcy impractical. Other just want to resolve their debt another way.
Most bankruptcy lawyers don't practice any other types of law and may not be able to offer other solutions to debt problems. I have many years experience in working with creditors to resolve outstanding debt through negotiation or settlement and defending debtors in lawsuits filed by creditors.
There are many defenses available to consumers being sued by debt collectors. Often the party filing the lawsuit is not the original creditor and may be unable to obtain the documents necessary to prove that the debt exists or that they have the right to collect the debt. Often lawsuits are filed outside the applicable statute of limitations. In Indiana, the statute of limitations is an "affirmative defense" which must be raised in a particular way by the consumer. If you are being sued or have been threatened with a lawsuit you must act promptly to protect your rights.
